Welcome to Thomas Tugnette Fine Art. By accessing this website or working with me, you agree to the following terms.

1. Overview

Thomas Tugnette Fine Art is a Kingston, Ontario–based studio specializing in original paintings and commissioned work.

These terms apply to all website visitors, collectors, and clients.

2. Artwork & Intellectual Property

All artwork, imagery, and content on this site remain the property of Thomas Tugnette Fine Art.

The purchase of a painting does not transfer copyright or reproduction rights.
I retain the right to photograph, reproduce, and share all work for portfolio, marketing, and archival purposes.

3. Commissions

Commissioned work is approached collaboratively, with clarity upfront.

  • A non-refundable deposit (typically 50%) is required to begin

  • Final payment is due prior to delivery or installation

  • A small number of revisions are included at the concept stage

  • Additional changes may incur added costs

Timelines are estimates and may shift depending on scope and scheduling.

4. Purchasing

By making a purchase, you agree to provide accurate billing and shipping information.

All prices are listed in CAD and are subject to change without notice. Payments are processed securely through third-party providers.

5. Shipping & Delivery

Shipping timelines and costs vary depending on size, location, and project requirements.

Shipping is included in the purchase price unless otherwise stated.

Thomas Tugnette Fine Art is not responsible for:

  • carrier delays

  • lost shipments

  • customs processing or import fees

  • damage caused after delivery or improper installation

Any customs duties or import fees are the responsibility of the client.

6. Returns, Exchanges & Refunds

Returns and exchanges are accepted on a case-by-case basis.

To request a return or exchange, you must contact me within 7 days of delivery with your order number and reason for the request.

Return Requirements

All returned items must:

  • Be in original condition

  • Be returned in original packaging

Customers are responsible for all return shipping costs.
Shipping costs are non-refundable.

Non-Returnable Items

The following items are not eligible for return or exchange:

  • Custom or commissioned artwork

  • Final sale items (if applicable)

Damaged Artwork

If your artwork arrives damaged, please contact me within 48 hours of delivery and include:

  • Photos of the artwork

  • Photos of the packaging

  • Photos of the shipping label

Damage claims are handled on a case-by-case basis.

You will be provided with the necessary information to file a claim directly with the shipping carrier.

Refunds

Once a return is received and inspected, approved refunds will be issued to your original payment method.

Please allow 5–10 business days for the refund to appear, depending on your provider.

7. Trade & Professional Partnerships

I regularly work with interior designers and art advisors.

Trade pricing may be available depending on the project, scope, and relationship.

8. Use of Website

You agree to use this site lawfully and respectfully, without misuse or disruption.

9. Liability

Thomas Tugnette Fine Art is not liable for indirect, incidental, or consequential damages related to the use of this website or purchased artwork.

10. External Links

This website may include links to third-party sites. I am not responsible for their content or practices.

11. Privacy

Please refer to the Privacy Policy for details on how your information is handled.

12. Updates

These terms may be updated from time to time. Continued use of the site indicates acceptance of any changes.

13. Governing Law

These terms are governed by the laws of Ontario, Canada.
